Name control required on an electronic 1099 file?

Q. I have a new software company for my 1099s. They are saying that the name control is not required on the electronic file and their software is not able to include the information. However, the way I'm reading Publication 1220, it says that name control is only not required if we cannot determine what the name control is. The FIRE test site does take the file as good but I am concerned. Is the name control something we are required to use? What are the potential consequences if it is required…
