For a consultant who lives in Canada that will be remote accessing our servers here in the U.S. to setup and maintain our Oracle database on an ongoing basis, will this be considered U.S. source income?
A form W-8BEN-E was submitted with the following:- Chapter 3 Status - Corp box marked- Active NFFE box marked- Foreign tin provided- Benefical owner of Canada with the box "Company with an item of income that meets active trade or business test" marked- Part XXV - #39 box marked
