Foreign software vendor refuses to provide a W-8BEN-E

Q. We have a vendor that we have identified as 1042 reportable due to them providing us with a software upgrade. We requested a W8BENE, but they refuse to fill out the form. Is there any known tax treaties that could possibly cover this charge with France? The foreign vendor is saying they pay and contribute to the salaries of people traveling in the U.S. and that each employee is subject to France taxes. The vendor states their employees do not have social security numbers and that it's taxes…
