Q. What 1099 form should my company send to property owners for easement or right-of-way payments? A. (Answered by IOFM's third-party tax experts) If it is for a perpetual easement or for a period of more than 30 years, the payment is reported on Form 1099-S, "Proceeds from Real Estate Transactions".  If it is for an easement or right-of-way for a time period less than 30 years, the payment is reported as rent income in Box 1 of Form 1099-MISC, "Miscellaneous Information".    95466
